Tier 1 entrepreneur - ILR SET (O) - Query

Dear all,

I am applying for ILR on Tier 1 Entrepreneur 50K. Iwould be grateful if you can confirm whether an applicant who established his own business is required to complete Settlement application SET(O) for Tier 1 Entrepreneur section ‘Part B – Created two full time equivalent posts’ from question B6 onwards as he DID NOT join or take over an existing business. The policy guidance is not clear but we are of the opinion that any applicant who does not join or take over an existing business is not required to complete Questions B6, B6b, B6c, or table at B7 as it is not relevant.

Your early response would be much appreciated.

You should answer NO to B6 but then you must fill the job creation tables B7. The job creation requirement applies under SET(O) to all applicants

I am applying for my ILR - 5 year route on Tier 1 Entrepreneur Pre April 2014 Transitional arrangement. For the job creation requirement, I am supplying pay slips, RTI's, P11's but I don't seem to have P46 for the employees. Is it absolutely essential to provide P46 and P45 forms?

The only specified documents are RTI and payslips. All others are optional

One more bit please , the RTI's given to me by my accountant says 'FPS Reconciliation Report'. It contains the following:

- The employees' Names
- Tax Paid
- Tax Liability
- Employees' NIC
- Employer's NIC
- NIC Liability
- Total FPS Liability

Just wanted to make sure it is the right one?

It is difficult to say. The requirements states "These must show every payment made to each settled worker as well as any deductions". I can't see the employee payments here, so I am not sure if it meets it.
