Over-stay move then 1yr now applying for Spouse visa

Post by kimk2018 » Sun Sep 02, 2018 3:23 pm

Hi,

Firstly, Please forgive for my poor English, { I some how passed my Life Skill in first attempt}

I came to the UK in 2009 on a student visa which had expired in 2012. I then made an extension on CAS{Confirmation of Acceptance for Studies} and had my bio-metric in the UK, which lead me to to have a further leave to remain for next 3.5 years { January 2016}. As i haven't completed my studies in past i found a great difficulty for my next extension. Even tho I then made an application in January and but haven't had any good reason to justify my past. My visa got refuse but i haven't took things very serious and stayed in the country. In March 2017 i decided to take my self back to my home country and phone the Voluntary Departure and stated them that i would like to go back. I booked my ticket of my own expense. Never done any crime, haven't taken any public funds .I now live in my home country from past 16 months .

8 months back i found a British girl on the internet. we fell in love and recently got married. She earn more then 28k, have her own property in london, Now i would like to apply for a family spouse visa and want to come back and stay in the UK.Can any one give me an idea what kind of things i have to go through. Will my past overstay will haunt my future application .

Some people said me as am applying for a spouse visa my overstay will be overlooked after 12 mouths .

And some are stating i fall into a 5 year ban.

All the people are saying to you this and that. Truth is with a Spouse visa your previous overstay should not be the only reason for refusal provided you meet all other requirements - so dont worry and make loads of duas

Make sure you explain everything on a statement and show that you are sorry for overstaying.

InshaAllah goes well for you.

The main challenge may be submitting compelling evidence of your relationship in order to convince the ECO that you haven't 'found someone' on the internet and married in order to re-enter the UK. :idea:
