Extreme in need of Advice

1. I came to uk in 2006 as student
I was in status till 2013 my last visa was psw then my visa got refused as tire 1 entrepreneur then did appeal,jr,court of appeal. Every thing got refused.
Currently i dont have any application with HO,
2. Currently my wife is pregnant and suffering from depression, I have a toddler and lack of funds and no work related documents have made my situation too hostile. We have spent days roaming in parks and sofa surfing at friend houses in night time. We are struggling to make ends meet. We are unable to afford rent or even food at times. But worst of all we have pressure from social services as we got referred To them by health visitor and psiacatrist and they are concerned about the wellbeing of my current child and unborn child. Our homelessness and statelessness put us in situation where we are living in fear that we might lose custody of our kids due to failure to provide them with proper living conditions.

3. Once our Jr and all applications were refused we personally tried going back to our country India voluntarily despite of all the issues. We did pack our bags and requested Homeoffice to facilitate our journey back to India in feb 2018 but unfortunately after trying a lot Homeoffice closed our voluntary return case due to no travel document for our son. We went to Indian high commission for help but since our son was not registered within first year of his birth with India high commission he is not entitled to Indian nationality and was issued non registration certificate. After which we were handed over with list of requirements for registering a child with Indian high commission after a year. According to their rules ORIGINAL-VALID passport of parent is mandatory to request for registration after a year(which has processing time of 6months to a year as approval comes from central government and state governments of India from parents birth place only after responsible ties are evident). We did explain Indian High commission and gave Homeoffice attested passport copies and tried explaining our reason unable to submit original but no luck. We went back to Homeoffice to explain our situation but Homeoffice said they can only give attested copies as per the rules.

4. Now having no status and no work right we were unable to rent a place of our own and having used up all our savings and having no financial support from anyone we are struggling to stay since beginning of 2018. We have been referred to different support services and a lot of immigration advice fromcitizen advice bureau and different immigration solicitors told us we can apply for different discretion based visa categories but lack of proper knowledge and no funds made it impossible to apply for any new application. We are facing homelessness and are relying on friends and charities for every basic need even after being qualified. My wife’s pregnancy and depression and wellbeing of my child so much is on stake but having no disposable funds I m unable to legalise my status.

5. PLEASE NOTE: we are in very desperate and hostile situation we tried going back but couldn’t leave our child behind. Homeoffice has its rules and so does Indian high commission and we got stuck in between. And this unplanned second pregnancy (baby due in dec 2018) made things more tough. All these situations made my wife depressed who previously had history of depression. Despite of pregnancy she is on regular antidepressants and sleeping pills. Psychiatrist referred us to social services due to our homelessness and now social services is behind f our back. During their last visit they clearly said THEY ARE VERY CONCERNED ABOUT WELLBEING OF OUR CURRENT AND OUR UNVORN CHILD AND THEY DOUBT WITH OUT SITUATIONS THEIR WELL BEING IS AT RISK SO THEY ARE CONSIDERING CHILD PROTECTION CASE and now I risk losing custody of my children due to my lack of proper house or work rights or savings.
6. Being concerned of our conditions we gotta letter issued by Psychiatrist and health visitor to support our case under medical reasons but we have no idea which application we qualify for. We were referred to a lot of level 1 immigration advisors who gave us prints of application form for stateless application for child, flro and some other but everyone said we only deal with level 1 you need level-2/3 advice to file application for which people were charging lot on money for file a single application. Everyone says it’s discretion based applications and we need a lot of supporting documents to represent our case. But to say anything further we have to pay. We had to chose between paying rent or paying visa fees and as a parent and husband I had to prioritise rent and food over legalising my status.
 
7. I need some to genuinely help me put one proper application where I have any hope to give a last try to legalise my self. Failure to prove that we are doing something to improve our situation or failure to do something can risk my kids being taken away and this fear doesn’t allow my pregnant and depressed wife sleep at night even with pills. My wife has 2.5 months due for our next baby, we can’t think of relocation at this time to a new country to a new place where we have no one or have no idea of any thing. My wife and toddler is dependent upon my and till my wife gets better I cannot concentrate on relocation or settling in a new country. Please help me out and tell us of any route we have possible. We will do our best to get any document requires and provide everything. Please find a list of documents attached with this explanation that I thought would be useful.
