Tier 1 Enterprenuer - ILR

Post by ukhan87 » Sun Sep 09, 2018 1:59 am

Hi

I am due to apply for ILR next year through 50 K entrepreneur root. I have few questions around my dependants

1. My wife has been my dependant through out the 5 years. Is she eligible to apply for ILR with me or does she now need to go through the spouse visa route?

2. I have two kids both born in UK whilst I held the entrepreneur visa. Do I need to apply for their visa as well with my ILR or can I leave theirs till I get the ILR and apply for their British passports through the naturalisation route? (both kids holds dependant visa's- expiring same date as mine).

Thanks

Usman

1. Yes, she can apply for ILR with you.
2. You can wait and apply for BC for your kids. You will possibly get an enquiry as to why the kids have not applied. If they have travelled and come in on the dependant visa, they will officially become overstayers - but that has not impact on their citizenship registration.
