Hi There,
I am overstayer came on tier 4 Visa in 2012 expired in 2014. After that, I applied for asylum on religious bases got refused in 2015. Since then I been staying in the country.
Met my Italian partner in March 2017, Relationship started in April 2017, She was my flatmate so been living together since March 2017. I am from Pakistan.
0ur Baby born in Feb 2018, She been working full time since we met but now she is on maternity leave until Oct 2018.
Applied EEA EFM (Working) IN June 2018 got refused in Aug 2018, For my own mistake really.
Changed address twice since living together, Submitted proof of addresses from June 2017 to June 2018.
The mistake I made is that I requested all of her bank statements from June 2017 to June 2018. It shows our current address. However, from March 2017 to June 2017 we were living at the 1st address and have not had any proof of address together. Then June 2017 to June 2018 I have vote Registration, NHS, EDF and Sky on my name. She has Payslips, Bank statements, NHS and some other letters. We did not have any joint account until Aug 2018. Her bank account has a current address so caseworker refused and said she been living here since June 2017 and You been living here Jan 2018. We also don't have joint accounts and pictures of you together are very from only when your partner was pregnant.

Going forward,
I wrote back to the caseworker, Told Him that he made mistake here, Her bank clearly has mentioned when the address was updated and we also provided our old proof of addresses dating back from June 2017.
Moved into recent address oct 2017 and I have edf from oct 2017 to Jan 2018. So you didn't check when the address was updated for my partner and just looked at an only bank statement, however, there are other letters from NHS and local council too and you didn't check that bill is for 3 months which issued in Jan 2018 but it is from Oct 2017 to Jan 2018.
He wrote back with no comment asking to resubmit fresh an application.
So I did, Put my partner as a joint account with EDF. Made clear that the address was updated in oct 2017 to current, however, bank statements requested recently from the bank will show current address even you request statement for the old month, Attached More Pictures, From March 2017 to June 2017 even though we didn't have any address together her address in bank was in south London but we lived together in central London so There are many Transaction showing in her bank statement from Local Area, I did Highlight those this time too. Attached baby birth certificate, Proof of employment, Letters from friends along with their proof of addresses and ID. Greeting card and also out what's app conversation when the relationship was started saying at many time stuff like when you coming home what to cook in April 2017.
I sent the application on 27 Aug 2018
RECEIVED AT HO 28 AUG
Fee TAKEN 29 AUG 2018
Bio Matric and Coa with no work as EFM: 10 Sept 2018
Bio Matric enrolled: 11 Spet 2018
Documents received: ??
Biometric card: Hope so??

Of course, I am nervous so that why I am posting this here to ask a few questions.
How many chances I have for success.
Our relationship is from April 2017 (No Proof of address together until June 2017 only bank transactions from the local area and what's app conversation from which you can clearly tell it's a couple.)
June 2017 to Oct 2017 is 2nd address we have, (we have DVLA letters, Council Letters just around 3 or 4 In total for each.
But In her bluebook all appointments with the midwife she mentioned clearly I was with her every appointment as well throughout.
Oct 2017 to Aug 2018
We have around 3 proofs of addresses each for each month but only one joint bill for one Month which is Aug.
2018. I have sky under my name and I clearly show them direct debit details and bills going from My partner account.
We do have GP together also a baby together given them a letter from GP and baby birth certificate. We have given around 100 pictures along with friends letters with their proof of address and ID.
Greeting cards. we booked an appointment to give notice for marriage back in June 2017 we didn't attend because financially we thought we can't afford because we had a baby on way. I have sent a copy of that with the same explanation.
We asked them on cover letter to interview us if they want to.
However there is always this uncertianity that they don;t read anything.
What you guys think ask me any questions which you have?

Hi Szuh

First of all, I'm sorry to hear you have had such complications. Your case is complex, and not helped by the fact that you overstayed your visa, but I guess (and this is simply my guess, I'm not a qualified immigration adviser), that now that you have a family, you do have rights to stay with them in the UK (or rater, they have the right to have you here).

It is impossible to answer your question about your chances without looking at the paperwork you submitted, but bottom line is, if you read through and reasonably followed the guidelines, and provided the required documentation, you should be fine. If you supplied incomplete documents, irrelevant documents, i.e., documents that do not prove your cohabitation as a family, then you might have more delays.

Again, as it is not possible to look at your paperwork, I can only give you the link to the post I wrote two years ago, as a summary of my experience in succeeding in getting a residence card as unmarried partner. I do understand my application is complicated and my Visa History does not help as well.
Yes, Main Major factor is that we have a child together, Our addresses I like to divide them into 3 sections since we met.
March 2017 to June 2017...
Met and started living together, No Proof of addresses Provided other than What's app conversation and pictures and greeting card. Which I don't think help a lot.
June 2017 to Oct 2017... Few NHS Letters, Vote registration and DVLA Letters. They are 2 each for us.
The mistake we made here she did change her address in the bank but we never had any printed statement or requested any. So when we requested in July 2018 that have our current address even bank statement is for June 2017. That is Main reason caseworker has given that she has a different address and I have different in DVLA. So this time we provided a letter from the bank that address was updated in Oct 2017 to recent.


Oct 2017 to Aug 2018: For this period our documentation is very strong. Almost 2 Utility bills for me 2 months, her bank statements and NHS letters.

Of course, Letters from employer and payslips, Baby birth certificate.


Here are my strong and week points in cases.
week Ones
Met in March 2017 to June 2017 we don't have proof of addresses together. Well, we have what's app to cover it and early this is an early pregnancy period too.

June 2017 to Aug 2018 We have covered all the aspects in every way.
We had a baby in Feb 2018.

So depends on caseworker now if he thinks week points will overcome strong ones or vice versa.

I spoke with a couple lawyers they gave me a lot of positive hopes this time saying that it was your own mistake in documents and you didn't submit clear paperwork. caseworker don't bother to go deep and check much.
But this time my documentation is very clear.
But you never know
