ICT Tier 2 main Applicant to Tier 2G Spouse

Post by Veekay123 » Wed Sep 12, 2018 2:06 pm

Hello,

My wife has a ICT TIer 2 visa (main Applicant) expiring on 10 Nov 2018. I was on a ICT Tier 2 partner Visa before and have recently got my own tier 2G visa. Now my wife wants to switch as my dependant. I am aware that the switch can be done in the UK but I need some guidance with the following queries:

1) Can anyone please share the checklist of documents I would need to submit for the T2 Spouse visa? I checked the PBS dependant guide and it is not very clear on what supporting document should I produce for a spouse. Also reading some posts in this forum, I ve learned that some of the rejections were because they did couldn't provide enough evidence of a subsisting relationship.

2) Considering that I had my spouse visa for last 4.5 years, is it sufficient evidence of subsisting marriage and relationship?

3) Would you recommend hiring a solicitor for the application or is the visa application process straightforward?

4) I heard that appointment for same day service is also with a wait time of 45 working days? I have only 38 working days left for my wife's visa to expire, is there any way I can expedite?

Please help

You just need to provide some documents showing that you are living together (if so), sharing the financial burden etc... can be proof of subsisting relationship (two each, and independent documents).

2) Considering that I had my spouse visa for last 4.5 years, is it sufficient evidence of subsisting marriage and relationship? You still need to have documents as mentioned provided, they do case by case.

3) Would you recommend hiring a solicitor for the application or is the visa application process straightforward? I don't think it is necessary, up to you for sure. Because just similar documents required when you applied ICT parnter visa.

4) I heard that appointment for same day service is also with a wait time of 45 working days? I have only 38 working days left for my wife's visa to expire, is there any way I can expedite? If your wife applies before her visa expires, she can continue her job even after her visa expires, while waiting the decision.

Please help

Thank you Cyclina1

1) To prove we live together, would the following documents suffice:

For me :
a) My salary Bank Account statement (shows our common address) , also would work as the minimum financial requirement for sponsoring a spouse
b) My Recent Council Tax Bill copy which is under my name (shows our common address)

For wife:
a) Her Bank Statement (shows our common address)
b) Recent Electricity Bill copy, which is on her name (shows our common address)

For Joint:

a) Bank Statement of a recently opened one joint account (a month ago)
b) Marriage Certificate (original)
c) Marriage Pics (Copy A4 Print)
d) Wedding Invitation Card (Original)

Do I need to print any WhatsApp chat, phone logs etc. as well?

2) Do I need any letter from my employer separately showing the maintenance for my wife or my/her bank statement is enough? My employer is a tier A rated sponsor and had checked the maintenance for migrant and dependants in my COS. ((Tick to certify maintenance for migrant (and dependants, if applicable): Y))

3) If your wife applies before her visa expires, she can continue her job even after her visa expires, while waiting the decision. : Would I need to inform Home office that application is under process ?

Thanks

Regards
