PBS Depandent - Divorce

Post by laila01 » Mon Sep 17, 2018 2:16 pm

Hi,

I have a question. I came to UK as a Tier 2 dependent. My husband got his ILR after 2 years. I am still on Tier 2 dependent visa.
We got married in India but didn't register the marriage here in UK. Now our marriage is not working due to behavioral issues and violence.

Can I apply for divorce here ?
Also is it possible to apply for ILR on the basis of domestic violence ? What sort of proof is required ?

Kind Regards,
Laila

Can I apply for divorce here ? No. I don't think so. You should divorce in India as well.

Also is it possible to apply for ILR on the basis of domestic violence ? Yes. But you need to have proof.

What sort of proof is required ? You report to the police?, your solicitor handling your divorce case?, Indian government acknowledgement you are separated due to domestic violence etc... They don't have standard list of documents but you need to provide something making sense.

Kind Regards,
Laila
