ILR A naive newbie story

Hello, everyone. I would appreciate greatly if someone could shed some light on my situation.
To tell the truth, I feel completely shocked and disgusted at the moment. I have been working hard for last 54 months and hoping to get my honestly earned ILR this year.
Dream on! And everything happens due to someone’s sloppiness.
But I have to fight for the sake of my son at least. He mustn’t be uprooted and make to leave.

Well, here comes the story.

I came to the UK as a holder of a Work Permit (for 24 months) in 26/10/2003; LTR till 26/10/2005. In October 2005 my employer applied for an extension of my work permit and a new LTR.

I got the letter confirming that the extension of my Work Permit had been granted on 14/09/2005, filled in an application form and sent it to the HQ of the company.

The HQ emailed my place of work on 10th October asking me to fill in a new form “due to changes in the administration of Leave to Remain within the Home Officeâ€

I think your, best bet is to apply in person in Oct 08 , when your will be eligible for ILR ie 5 year mark.

You can explain to the case officer, that you had submitted your application on time in Oct 05 , but the HO held up the process.

This, they should be able to confirm with thier own records.

Don't worry your case is relative straight forward.

I filled in the new application form on 11/10/2005 and sent it to the HQ.
Was that form sent Recorded Delivery? Can you prove when it was posted?

Hello, Siggi. Thanks for getting back. As far as I can understand, the hold up in my case was caused not by the Home Office itself but the Recruitment Officer in my company’s Head Office. I received photocopies of my file from Data Protection Unit, UK Border and Immigration Agency and there is a copy of the FLR/IED Application I submitted back in October 2005.
At that time I signed and dated it 11/10/2005 and sent to the Recruitment Officer at the same day. She signed and dated it – 01/11/2005. The Home Office received the application on 3/11/2005.
I start worrying about my case being too complicated. Would I be better off if I applied by post with a good covering letter explaining things?

Thanks for a reply, John. I sent it by a special delivery. Unfortunately, I do not have any proof of posting at the moment. I wonder if there is a chance they keep records of recorded delivery somewhere in the Royal Mail data bank for such a long time?
