Can i apply for ILR with the job offer letter or i'll need a Tier 2 general visa first?

Hi, I was wondering if anyone can help.

My 6 years on Tier 2 complete in January and I have been offered a new role in the same company but in a different SOC code which takes me over the minimum £35,500 bracket to apply for the settlement.

My question is, will my company have to apply for Tier 2 work visa in the new category first before I can apply for the settlement visa or can I apply for settlement/ indefinite with the contract letter offered by my company as I have already been on Tier 2 for more than 5 years?

If the company will apply for the new tier 2 visa then will home office just give me the visa for a couple of months (until Jan) and I will have to apply for settlement before my visa expires?

The company will need to carry out a proper RLMT for the new role and then apply for COS before you can apply. The earlier you apply the better. You will have to pay the full application full but will only be issued a visa valid till January when you will clock 6 years on Tier 2. I will advise you use premier service. so, you need another Tier 2 visa in the new SOC code before you can apply for ILR. If the new role is on shortage list, then the RLMT might not be required.
