ILR early response letter.

Post by pauldm21 » Mon Oct 01, 2018 12:40 pm

Hi folks,

I submitted my wife’s SET (M) application on 27/07/18. We posted all the supporting docs on 08/08/18, we left it quite late within the 15days as I was still waiting on my letter of employment from my employer.

It actually reached the point where I realised I wasn’t going to get the letter of employment in time so we posted everything else we had. The next day I received the letter of employment so this was posted separately with a cover note explaining why it was sent separately. The bulk of our documents were received and signed for on 09/08/18 and the letter of employment received and signed for on 10/08/18.

My wife and I were then away from home for a couple of weeks, and when we returned on 24/08/18 there was a letter from the home office saying “YOU HAVE NOT SUBMITTED A VALID IMMIGRATION APPLICATION”. the letter went on to say we had not sent any mandatory documents, had failed to include a valid passport for you and your sponsor, and failed to sign and send the sponsors declaration. It then said the consequences of not sending the information within 10 days would be you will become an overstayer.

We obviously sent all of the required documents. The date on the letter was 10/08/18 (only one day after our documents were received and signed for. So part of me assumes this is an automatic letter sent because the documents hadn’t been filed against my wife’s application yet. But then we’re also thinking it’s possible the paperwork has gone astray somewhere.... the only other communication we’ve have was an email on 28/08/18 saying the application was under consideration and to expect a response within 6 months. Which is reassuring but we’re still worried about the first letter. Does anyone know, if the application is rejected based on lack of documents, do they follow that up with another clear letter confirming the application is rejected?? I’ve called, emailed and written to them seeking not an update but just a confirmation that the application is being processed but get no response.

The only thing we forgot to include with the application were photocopies of everything. Wage slips, bank statements etc were photocopied but but some of the letters we just sent originals. Surely they wouldn’t reject it so quickly for some missing photocopies?

Just seeking a bit of reassurance really. Hopefully the email dated 28/08/18 overrides the letter dated 10/08/18?! Surely they would have followed up with a rejection letter by now if the first letter was correct?

Thanks in advance
