Received letter to pay more visa fee - Tier 2 general dependent

Post by Shah1698 » Mon Oct 01, 2018 5:03 pm

Hi there

I applied Tier 2 general extension for my family (3 dependents) for further 2.9 years.. and paid visa fee for 3 years. However, UKVI sent top up payment pro forma asking to pay fee for over 3 years (but visa we applying is only for 3 years)

They are asking to pay inline with my visa, which was issued last year for 4 years, in which only less than 3 years left now.

I don't understand why I need to pay for over 3 years when I am not applying. This is their response --

"You have submitted 3 dependents application to join Mr XX. The fee has to fall in line with his Tier 2 General application which covered more than 3 year period. You have paid £704.00 for the 2 dependent's applications, however, the correct fee is £1408.00 each. Consequently an extra £704 each is due (total amount owing is £2112.00)"

I would be grateful if someone let me know who has gone through similar situation, what they have done or any idea why they asking to pay more? Thanks.

Have you extended your visa? do you know when is your expiry date?

Thanks for your response.

I have moved to another sponsor in June 2017, for 4 years visa (expires in June 2021). My family had previous visa until 10 Oct 2018 so I didn't apply for them at that time.

It's been over 1 year now since I got my 4 year visa, now only 2.9 years left. I have now applied to extend my family leave by further 3 years (2.9 yrs) and paid fee that covers 3 year visa. however, I received letter to pay visa fee that covers more than 3 years :(

They said -- If I don't pay, my family visa will be rejected and they will become overstayers as they leave expires in few days and any new application will be considered as if it's applied after leave is expired.

I have sent my card details as I cannot take risk at this moment but not sure if I can appeal this and get the fee refunded? Any help will be greatly appreciated.

Remember seeing a couple of similar threads based on which I am responding.
The dependent visa fee will be inline with the primary applicant's visa duration even if applying for less than 3 years
Unfortunately that's how it is
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.
