10 years residency

Post by flavourx » Thu Oct 11, 2018 9:29 pm

Hi
My immigration history is that, i came to uk 2009 sept as student finished in 2012, post study in 2012 to 2014.
Entreprenuer visa granted 2014 to may 2017. Applied for extension in 2017 may and was refused in 2018 feb, reasons being genuine entreprenuer after interview. spoke to solicitor and was advised to apply for flr fp to buy some time till sept 2019 before ilr, but flr fp was refused in oct 2018. I have a wife and baby of 1year and 2months as dependant.

Please i need advise on how to proceed. The current solicitors i spoke to dont seem to have an answer.

What were the reasons for refusal ?Were you given an in country appeal? Do you have a child that has lived here for 7years+,If yes then you might have a chance at appealing which might give you some time before September 2019

Reasons for Refusal
unfounded claim - based on family back home, medical grounds and FGM. They said i should be able to integrate with family back home easily as i have spent some years with them before coming here.
No in country appeal. Solicitor not wanting to put in an appeal for me or do Judicial review. Child not up to 7 years.
So i really need suggestions on what to do next. Being advised by solicitors to reapply for FLR fp or just apply for ILR. Please what can i do.

I am very sorry to hear about your case. Your solicitor completely misled you. FLR (FP) cases normally strong when your child age continuous residence in UK 7 or more years. Your claim is unfounded means your claim is certified by Home Office. This is special power to caseworker where they stop applicant appeal rights. If you go in JR so your JR normally will be refused.

I am not satisfied why your solicitor suggested you to apply FLR (FP). You should submit a new case after refusal within 14 days on Tier 1 Ent.

I don't think your long residency will continue after applying JR. The only option is in my mind to apply JR if they will take time and you completed 10 years in the UK may be it will help you as Article 8 grounds.
