I'm wondering if anyone who has been through the process can clear things up for me.
Basically my contract at work I'm contracted to work between 60-78 hours paid at 16.28 pounds an hour. Therefore my basic fixed salary each month is at a minimum (60*16.28= 976.80) or (78*16.28= 1269.84) Therefore I'm paid this basic salary depending on the number of hour I do. However, if I go below the 60 hours, they pay me the lowest fixed salary and I will effectively owe my company time.
If I work over the 78 hours contracted, I'm paid 17.09 pounds an hour 'overtime'.
I'm confused as to whether I qualify as a non-salaried employee since the amount of hours I work a month changes depending on certain circumstances, and therefore my pay is different each month. I think I'm non-salaried but can anyone confirm this?
Recently, I've been averaging around 100 hours a month. Therefore I've been paid (78* 16.28) + (22 * 17.09)= 1645.82 a month which if they use the non-salaried criteria, would be over the 18600 limit. Additionally I will be paid 'bonuses' such as holiday bonuses and end of contract 'severance pay' during these next 6 months. Will these bonuses be counted towards the financial commitment or not?
