UK Standard Visitor Visa - Minor - Income and Expenditure

Post by crgr » Tue Oct 16, 2018 4:29 pm

My wife and I are filling out the standard visitor visa application for our 15 year old niece and are unsure about how to deal with one question in the Income and Expenditure section.

We will be supporting her 100% - travel, accommodation and living expenses.
We will be specifying the amount we expect this to cost in the question: 'How much money will they be paying towards your visit?' (This question is in the section regarding 'Who is paying towards the cost of your visit?') We will be answering this with £2300.

The question I have doubts about is:
'How much money are you planning to spend on your visit to the UK?'
Should this answer be the same amount(i.e. £2300)? Or should it be £0, as the 'you' in the question, i.e. our niece, will not be paying anything out of her pocket.
If it should be £0, it should be noted that the form doesn't allow you to enter £0, it requires an amount.
Thanks.

UK Standard Visitor Visa - Minor - Letter of support / form

Post by crgr » Tue Oct 16, 2018 7:36 pm

My wife and I are filling out the standard visitor visa application for our 15 year old niece and are unsure about whether we should provide a letter of support or a form showing our financial support.

We are both in the UK on my Ancestry Visa with BRP. We will be responsible and supporting her 100% - travel, accommodation and living expenses, and she will be staying with us.

The Visitor: supporting documents guide specifies:
where a third party (who is either in the UK or who will be legally in the UK at
the time of your visit) is providing financial support to you e.g. a business, a friend or a relative, documents to show they have sufficient resources to support you in addition to themselves and any dependant family should be provided.
We will be providing copies of our passports, BRPs, and bank statements.

Our question is:

Should we provide some sort of letter of support/invitation? Or is there a form we need to submit with the application?

It's very difficult to find the answer to this in publicly available information. We have been looking at links:
* If you're under 18
* Documents you must provide
* Visitor: supporting documents guide

However - we have found more information that seems pertinent in the Visit guidance site, which it should be noted is actually guidance for Home Office Staff, not for the public.

In this Visit Guidance the section "maintenance and accommodation" directs you to another page with the link "See: paragraphs V 4.3 to V4.4 of appendix V: visitor rules." On this page, called Immigration Rules, V4.4 is as follows:
V 4.4 The third party may be asked to give an undertaking in writing to be responsible for the applicant’s maintenance and accommodation. In this case paragraph 35 of Part 1 of these Rules applies also to Visitors. An applicant will normally be refused where, having been requested to do so, the applicant fails to provide a valid written undertaking from a third party to be responsible for their maintenance and accommodation for the period of any visit.
Also in the Visit Guidance, the section "Sponsor undertakings on maintenance and accommodation" directs you to ‘Recording requirements for UKVI: sponsor undertakings on maintenance and accommodation’. In this section, it says:
You should complete the certification on the sponsorship undertaking form, keep a copy on file and send the original sponsorship undertaking to the Department for Work and Pensions (DWP). Please refer to local address list for details of where to send to.
This contains a link to form SU07/12, titled "SPONSORSHIP UNDERTAKING".

So - the question is - should we follow the advice in "maintenance and accommodation", which seems to suggest we should include some sort of letter, or should we follow the advice in 'Sponsor undertakings on maintenance and accommodation'', which seems to require this SU07/12 form?

I have a theory that we would not qualify as 'sponsors' as we are not British citizens or permanent residents (we have 5-year ancestry visas), but I'm not sure.
