MN1 SECTION 1(3)

Hi guys,
Would like to get some help.
HISTORY:-
daughter born May2010 I had no stay then, mother was on student visa.
mother and daughter left UK in January 2011. (she was only 7 months old and also was given BRP card) since then they are in Pakistan
I got ILR in 2017.


question is
can I apply MN1 for my daughter under Section 1(3), as far as I know when one if the parent get ILR child is entitled to be registered as BC.
I am only confused about residency requirements, there is nothing mentioned in law about residency.
I know I can apply but want to make sure about residency is required in UK OR NOT?
Reference from Law needed. if residency is not required shall I leave it blank?

MN1 form latest version page 9, residency details are asked. (I HAVE BEEN TOLD BY SOLICITOR, my daughter has to be living here otherwise they will refuse it. According to him MN1 guidance requires residency in UK.)
I am really confused; can anyone direct me to the law whether daughter has to be living in UK. Or on page 9 of MN1 form residency is for the other options of the application for example under section 3(1).


Page 27 asks consent; do I have to sign here and wife from Pakistan? Or parent is enough?
Page 20, needs referees who should know child personally
If I apply from UK who then will give a reference? Or I need to get from Pakistan only
From teachers let’s say.

Suggest do I need child's original passport and BRP here in UK?. Or copies are fine.
HOW ABOUT BIOMATRICS where she will give? passport will be here; do they not need identity?
do I need mother's passport as well?
do I need marriage certificate translated in English?

Kindly please please if possible guide me in the right direction.
