FLR(LR) is there any chance

Post by callums » Wed Oct 17, 2018 8:11 pm

Can any one please help in my difficult situation
1. Came to UK in student visa in 2008August
2. Extended student visa again in 2010
3 Applied for PSW visa in 2011 october
4. Application returned in November 2011 as photos not present and despite requesting didn't send according to home office.
i got this information from SAR , it was solicitor's action , he didn't contact me and he just lied to Home office
5. Again applied on Jan 2012 and application returned as payment error. Solicitor was trying to push the time forward without telling me as what he was doing , just collected the money from me as his fees, As my master degree results weren't out, without that psw may have been rejected as he thought. he could have submitted an FLR
6. Applied again in that given time-frame and it was February 2012 through same solicitor
7. Obtained PSW in 2012 August
8. Secured Work Permit in 2014 August without any hassle
9. Licence of the company reworked in 2015 December, but i didn't receive the letter of curtailment, but according to home office it had been sent.
10. applied for curtailment letter through new solicitor as the previous one was dodgy, got it in 2016 april and applied for FLR(FP) on time.
11. in march 2017, solicitor firm got a letter saying i had been given a chance in October 2016 and didn't turn up, we both but hasn't received the biometric invitation letter. They asked to submit a fresh application and they are giving me a chance it clearly said in HO letter. But in SAR it says rejected in march as outside rules and they would be returning the flr application payment - a £25 admin charge and they did later.
12. Applied and given the biometrics just in april on the same year. And since then i had been waiting and waiting calling solicitor firm everytime for update
13. on 29 th June 2018 found the nhs refund in bank and ran to the solicitor, they checked and found no rejection letter for me.
14 on August 1st2018 itself made FLR(LR) and gave the biometrics just a month after, as i didn't have any ID to go for like in uk test, so no way to submit an ILR APP. when SAR(generated in june 2018) came i /we learned the decision had been taken in MAY 2018 itself as rejected, but solicitor told me, even in the history it doesn't say about the decision had been communicated to any one of us though made. So not a problem and it was true that no letters came to both of us. Had we got it on time we could have put up a new application.
so what you experts think, will i get the visa, i am just myself in the country , just to confirm of any family ties.
solicitor says probably i will get rejection(because of 2011-2012 issue) with right to appeal as i had went past 10 years and if not they will get me a right to appeal

Without any family ties in the UK, your chance of being granted settlement under FLR(LR) is slim. You should however, follow the advice of your Solicitor...that's what you're paying them for.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

that true and i have been doing, as they said they will get me a chance to appeal if not given straight by ho, as they normally do for the 10years cases. but i am just not looking for anything else from family ties, its already 10 years for me here and didn't have a chance to go for life in UK test as no id with me, thats why i didn't go for ILR application, i hope you understand. i don't know about flr(lr), just because the solicitor told me to do that particular day itself, as they said its for someone who doesn't have life in uk test and passed the 10 years mark legally
