I'm not at all sure if this is the correct section in which to post this, but here goes...
I am an American citizen and my (now) husband is British (born in the UK to British parents). We had a daughter together while we were living in Indonesia. Indonesian authorities would not allow the father's name to be on the birth certificate because, at the time, we weren't yet married. Soon after the birth we obtained a U.S. CRBA, which lists the father's name and date of birth.
We are now residing in the UK and have been for nearly 6 years. I am on a spouse visa about to apply for ILR. My daughter entered the UK with her American passport which has recently expired. I realise that her entry to the UK was illegal but we didn't think much of it because she is a British citizen by descent and we thought we could easily prove that and get her a UK passport.
When we applied for her UK passport we supplied her father's birth certificate, our marriage certificate, and her U.S. CRBA. We were sent an email saying the passport office needs her original Indonesian birth certificate, which we don't have and which won't help anyway because the father's name is not included.
My question is: if we provide DNA test results, is that likely to be sufficient to prove her father's natural and legal paternity? Also, will they still require the Indonesian birth certificate, even though it has no bearing on her British citizenship? (Side note: being born in Indonesia does not confer indonesian citizenship so, at the moment, she is only an American citizen and America allows dual citizenship with UK)
I'll be grateful for any help or guidance!
