Section 7 - Personal History - Domestic Violence Incident

Post by Santosh40 » Wed Oct 24, 2018 9:51 am

Dear All,

I'm applying for ILR from TIER2 category and i have a question regarding Section 7.

7.3 Have you, or any dependants who are applying with you, been subject to, or received, any
other penalty in relation to a criminal offence; for example caution, reprimand, warning, or similar
penalties in the UK or any other country?
7.12. Have you or any dependants who are applying with you ever engaged in any other
activities which might indicate that you may not be considered to be persons of good character?

Two years ago, i had a small argument with my wife and in a fit of rage she called the police. The police came in, spoke to us and left. I have never been contacted by the police thereafter.

I requested a SAR on police records and this is the only information they have about me on their files (shown below). My question is - should i mention this incident in Section 7.3 or 7.12? Will this affect my application?

Crime No: xxxx/xxxxxx/xx
Incident No: xx-xxxxxxxx-xxxx
WMC Offence: DVxxxxx Emotional Domestic Abuse Incedent (I)
MOPI Group: X
HO Offence: DVxxxxx Emotional Domestic Abuse Incedent (I)
Validation StatusL 3
Status: OFFENCE
DETAILS: Female party called police following an argument. Female party seeing doctor for depression. On arrival police separated both parties. There were no offences and both parties wanted to stay together to sort difference. Police have never been called out before and there has never been any violence towards the female party.

Thanks for your valuable advise.

Only convictions recorded on your criminal record need to be declared. A simple police report has no effect on your character

Thanks for the reply Zimba. What about for question 7.3?

Same thing. The question is self explanatory and your situation has nothing to do with those issues mentioned
