YOUR URGENT VIEWS NEEDED FOR EXTRA ORDINARY SITUATION I HAVE BEEN IN.
My case is slightly lengthy but please read it and guide me............................. I have tried to be specific and to the point. Here we go !!!!!!!!!!!!!!!!!!!
I arrived in Belgium in 2006 and applied regularization in 2009 which was accepted in 2010-11. They gave me temporary card for one year work on the condition if i can find the work full time (which i did find). At that time 3 year rule was in place to get permanent residence, however while on second year (i think) the rule was changed to 5 years (instead of 3 years at the time when i started this cycle).
>>> Normally the new rule is not for people who are already under completion of their existing cycle>>>>> But in my case they extended this condition on me also.
I have been working throughout (changing different companies), but altogether i have been working continuously for 52 months (full time, without any interruptions and paying taxes etc).
In April 2016, i had a situation that entangled me into extra ordinary circumstances: (Long story short) = Not knowingly i was checked by work department, working 7 days (when i was supposed to be working 5 days, at the time of check i was not aware of this restriction). In the days of this check, my company was running short of staff so my boss asked me to work 7 days. (Me and my boss had flexible understanding to take 4 to 6 days off at the end of month once he find new staff, i have proof of such extended holidays). In short i was asked by the work department that my work permit with this employer has been cancelled.
Further i was mislead by a famous lawyer (xxxxxx xxx from Antwerp), who took me on appeal track (he gave me a hope that i will be reinstated with same employer (instead of guiding me to find another job and complete my 5 years, i still had 6 months card left. i came to know about this later on).
While waiting for appeal outcomem my card expired and after expiration appeal was also refused.
I Didnt know what to do (for next 1 and half year), finally i contacted a new lawyer who applied my case (on humanitarian basis) in December 2017 and address was finally confirmed in August 2018.
Now i am waiting for the outcome of case. (Lawyer said outcome is expected in 2 to 4 months? is it true?)
All the interruption was either not my fault (or my lack of knowledge).
Can you please guide me if i have any chances to gain my legal status in belgium again for my pending case, especially working rights \ any chances if i can get permanent residency , when it was my boss fault > i certainly need your kind \ expert views about my case. What is the outcome of such cases mostly, in light of current law.
Many Thanks for your cooperation. Any replies will be appreciated.
