Visit Visa for Plab 2 exam - History of rejections

Post by zed1 » Sun Oct 28, 2018 1:41 pm

Hi everyone,

I would like some guidance from your side in regards to my brothers complicated visa history, the case history is as follows:

Case history :

I moved to UK along with my family few years back on tier 2 dependent as my father is a doctor here and now my whole family has been issues ILR here in UK. My brother however wasnt issues a visa back then when we moved to UK as he was over 18 and he went on to study medicine in Pakistan. Since then he has attempted a visit visa twice and has been rejected on the grounds of "strong ties in the UK and no evidence he will return to Pakistan". Now he has graduated and is currently working in Pakistan as a junior doctor, he recently passed his PLAB1 exam and is now required to appear for PLAB 2 in the UK for which he needs to apply for a visit visa again.

Problem :

Due to the past visa rejections, we are concerned that he might be rejected on the similar grounds as all of his family is based in the UK. He is required to appear in the PLAB 2 exam in UK and return within a week to continue his Job there.

Has anyone been through similar situation and can someone please suggest any tips to make his case stronger for the visit visa application this time.

Many thanks all,

There is no provision and law he was refused on the basis that he has strong ties in the UK. However, he must show his intention that he is coming to appear in PLAB 2 exam which is not conducted outside the UK. He attached PLAB 2 exam booking and his job letter, payslips, bank statement. Once he passes the PLAB 2 exam which I think he might be able to get Tier 2 visa. Also, HO won't be able to stop someone to appear in the exam.

There is a lot of things you brother can challenge their decision in JR or Admin Review.

Unless someone sponsors him (company) for the PLAB test or he applies for a Tier 2 visa, it is almost always unlikely he will get a visit visa given his whole family are in UK.
