Change in job code with existing employer 3 months before change of employment?

Post by returntoforever » Sun Oct 28, 2018 6:04 pm

I am offered to work in a new division with my current employer starting in April 2019 and also a new job with a new employer. I am guessing I'd need to apply for a new visa in March with my current employer, then May/June with my new employer. Would it be an issue since my new employer will probably have to apply for a CoS and do RLMT for me in April? Would HO look at both and think wth is going on?

Many thanks!!

Your current employer might also need to do another RLMT for the new role you want to move to. So it's not as easy as you think. If I were you, I will continue the current role and then move to the new employer when I have the new visa from the new employer or stay with the current employer in the new role.

You can only be assigned a COS per time. So I would expect your current employer to have completed the RLMT and issue a new COS long before you resume the new role in April. If you are also planning to start a new job with a new employer in May/June, it is a good practice to get your visa a month or two before resuming, assuming you will have a notice period to complete in your current job.
In short, applying for visa twice within 3 months is not an issue, the challenge is in the timing and cost. Why do you want to get a new visa with your current employer in a new role and then change job a month later?
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
