Help.

Post by Ks5bns » Sun Oct 28, 2018 8:35 pm

I apologise if this is these are stupid questions but I need help.
I am a British citizen
I married my wife whos pakistani
After showing government I was earning £18 600 they gave her leave to remain for 3-years.
However since my hours have been reduced and I will be getting less than 18,600.(14,800)
With overtime I can get more but not 18,600.

My question if my earnings isn't enough will she be sent back to pakistan?
Aditionally we have had a child who is a British citizen. And get child benefit
Does that count towards 18600?
Or will this not all matter and she will still be allowed to get IRL.

Child benefit won't qualify to meet the income level of £18,600. If you aren't able to meet the minimum income level your wife should submit a FLR(FP) Partner route application .

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

FLR (FP) is longer route , someone can apply ILR after completing 10 years on such Leave to Remain.

Best option is your wife could get job to earn and meet the shortfall of £18600.
