Visa or Join date to calculate for ILR

Post by rr6699 » Sat Oct 27, 2018 8:39 pm

Hi,
Tier 2 visa issued date with in UK: 04-Jun-14 (switch from another category)
CoS date:20-Aug-14
Joining date:03-Oct-14 (Notice period till Aug and could not join in Sept due to personal reasons)
Visa extension:03-Oct-17

Questions:
1) To calculate ILR eligibility period, is it from Visa date / CoS date / Joining date ?
2) If it is Visa date, Does the case worker consider gap between visa date and Join date (4 months) as allowable absences under continuous 180 days? If yes, ILR eligibility will be 04-Jun-19. Is Submitting experience letter from previous company till Aug'14 and letter for Sept'14 will be sufficient?

Please advise

ILR via Tier 2 - Letter from Previous Employer

Post by rr6699 » Mon Oct 29, 2018 5:35 pm

Hi Zimba, Two queries
Is it 30 days or 30 working days absence per residence year ?.
If absences within UK does not exceed this limit per residence year, we don't need to give letter with reasons, am I right?
Please advise

Absenses only require a supporting letter if they were outside of the UK. Not within the UK.

Ok. For example, within UK, if person exceeds his / her annual leave (24 work days) and takes additional 6 or more work days so 6 or more work days will be loss of pay. Here, I believe either personal letter with reasons or letter from employer is required, am I right?

Please do not hijack someone else's post. That is why your ILR questions have to its own topic now. Stick to this post for your questions.

No. Absences letter only is relevant for absences OUTSIDE the UK, regardless of them being working days or not.

1) It is from visa issue date
2) I assume you were NOT outside the UK, no need for an absences letter

Hi Zimba, sorry about that. I should have mentioned some more details in initial post.

Visa issued date: 04-Jun-14
After working 2 months in UK, travelled out of UK on 3-Aug-14 to complete notice period till 31-Aug-14.
Returned to UK on 3-sept-14 but could not join new company due to personal reasons and joined on 3-Oct-14

Here, existing employer will not give absences letter for Aug-14 as it will be before joining date and old employer will also not give absences letter as I left company and I have not worked in UK for Aug-14.

So, checking with experts to know whether this period comes under allowable absences or personal letter explaining reason is valid to cover Aug-14 absences along with experience letter and passport entries?. Please advise

Thank you
