Hey Guys,

I need your help.

I re entered the UK on a tier 1 entrepreneur visa in 2014.
I set up my business and now runs at a profit, I own my work premises etc.

In 2017 my tier 1 visa was due for renewal and as I was engaged to a British National I changed to a spouse visa for nothing more than simplicity, which I now hold until 2019.

Sadly my relationship is failing and I’m at a loss of what to do, I have sank every penny I’ve ever earnt into this place and fear when I inform the HO that I’ll have to walk away from it all.

Can anyone advise of any past experiences, what if any options I have?

For further info, I have actually resides in the UK since 2010, I was married to a British National at the time, in 2013 I had to leave and apply for a tier 1 entrepreneur.

Unfortunately, the only option you possibly have is to leave and apply for a Tier 1 E again. It means you will need to show access to funds.

Once you are back on T1E, you can apply for your ILR in 2020, assuming you have not had a gap of more than 180 days between when you left in 2013 and came back in 2014.

You can also look into whether you may qualify for a Tier 1 Exceptional talent visa.
