Advise needed urgent

Post by Osol » Fri Apr 06, 2018 1:26 am

Hi all. So my story is a bit lengthy. Met boyfriend 8 years ago, he was on a student visa. I’m British citizen; his visa expired and when he applied a little late was rejected. He appealed plenty but to no avail. He was attending signing for a short while then deciding to stop in fear or being detained and deported. So he has been an overstayer. Also shortly before meeting me he got married but did not stay with her more that a month as he found out she had been cheating.

We had a baby nearly 2 years ago and have been living together about 4 years. I was earning 24000 per annum until last year where it’s now 12000. We recently applied for leave to remain as a spouse and parent. Our baby’s birth certificate was amended at add his name as it previously wasn’t there due to family issues. Also on our baby’s passport she uses my surname.

The relationship has broken down since application and we will be leaving our shared home in a month. I think he was cheating.

How do I move forward with things. Will he still be able to stay and be in our child’s life? Can he still get granted leave or can he apply with another person, assuming he has a new partner now?

Your asking questions which have no answers. He may get leave if he meets it through other routes. He could well in future apply access to see his child. As a father he does have right to see his own child if he meets the criteria. After all, it is his CHILD!.

He may well have been married all along, who knows.

No one knows the future and if's and but's.

Best for you to learn from this and move on.

Flr - change of address

Post by Osol » Thu May 10, 2018 10:12 am

Hi guys just wondered if a change of addresss whilst waiting for response for flr m would affect anything.

How do we inform them and would they need that we are moving together.

Application was send end of March, we are looking to move July/August. Have been following the timeline thread, don’t how long this takes.

Thanks

Switching from partner route to parent route

Post by Osol » Sun Nov 04, 2018 5:16 am

Hi all,

Please can I ask what the requirements are for parent route 10 years and parent round 5 years?

Also how easy is it to switch from partner route to parent round after a relationship has broken down?

My ex granted partner route about a month ago. I haven’t called to inform them of the breakdown of our relationship and I’m not sure of any obligation on my part. I don’t think he will... we have a child together anyway, that’s why I’m asking about switching?

Parent routes:

D-LTRPT.1.1. is the five year route.
D-LTRPT.1.2. is the ten year route.

Thanks for taking the time to respond Vinny. Have followed links and also searched online. I can’t seem to make out clearly how one can meet the criteria for parent route. Additionally the proof often provided within such applications.
