FLR FP application for failed asylum seeker with lost passport

FLR FP application for failed asylum seeker with lost passport

Dear All,

I am married to my husband from 2016 and we have been together since 2014. I am a British citizen and earn above the threshold. My husband came to the country on a student visa and this expired in 2013. He got cheated by a solicitor who claimed to put in an asylum claim but put a family visa and this was deemed invalid. My husband then sought new legal advice in 2014 just before we met. He then applied for asylum. His asylum claim was rejected in jan 2016 and since then we have appealed the decision and have exhausted our appeal rights. We then put in further submission based on our marriage and medical evidence, this was also refused. We then put a jr and this was accepted. HO issued us consent order and so we removed our case. They then gave us another refusal October 2018. I am now confused with what to do next. I don’t want to send him back but his passport has been expired and was lost in 2013.
What are my options? Can I apply for flr FP without his passport?

Please help me.
