ILR application after DLR

If anyone can advice I will be really greatful. I applied for ILR (Long Residence) in 2016. Got refused under 322 due tax amendment. Went into appeal and judge didn't accept justification for tax amendment but allowed appeal on child base under article 8. HO granted 30 months visa to me and my wife. Now question is when I can apply for ILR? Im in UK since 2005.
