Urgent help needed! Re:ILR

Hi,

I'll try to keep it sort.....

A good friend of mine has come from Pakistan on a settlement visa, for a 2 year during, after which his wife has to apply for him to get ILR in the UK. unfortunately him and his wife have had a disagreement a couple of days ago and she is refusing to support his application. He also has a child with his wife ( i dont know if this is relevant

)

But what i would like to know is what he can do to remain in the uk or will he be deported?

P.S his visa expires in 3 days

I would grately appreciate your help

Not much as in, not much he can do? does that means hes going to be deported?

or can he apply for an extension without her consent?

No one will deport him if he has a valid visa but obviously if his visa expires then its a different story, He will become an overstayer which automatically makes him illegal and liable to be detained and removed from UK.

I feel that it is unfair that his wife can control such a big decision, jus because they had a disagreement, surely he could do something, or is this not the case?

He can not do anything else I am afraid. Remember he is in UK because of his wife as she sponsored him and she can withdraw her support if she wants before he gets his ILR.

Interesting and unusual case. What if the court proceeding haven't started yet like Noreen.akhtar's friends case?

so long he initiates a court proceeding and has a letter from the court or a receipt to confirm that he has a pending case then it should be fine. He of course would have to prove that he supports the child by providing evidence of child support etc.

Since you don't explain how long the marriage has been for which is a factor.
I also presume that the spouse is a UK national and your friend came via a UK spouse route vs EEA route although I think there is similar provision for the non eea spouses of UK nationals but you'd have to find it.
