can some help regarding my wife who has not stay in the uk.

Post by niljam » Wed Jun 04, 2008 11:08 pm

i am a british citzern and marriage to my wife who is chinese..... she is on a spouse marrige visa for two years which run out in two months time,
the problem i have is that within the two year she has not stayed in the uk with me.... as she is waiting for her company to sell in china... then she will be able to get certain financail benefits so i did ask her to reamin in china until this is sorted out...however i have visited her on a number of times by going to china... as well as she within the last two years she has only spent 7 months in total being in the uk....
what can i do should i apply for a extention visa... and can i do this service in one day..... she will be arriving into the uk agin in july spending a further two months here in the uk

she first arrive in the uk in decenber 2006 she abtain her visa on septem 06

she has in total live with me for 7 months

the visa runs out in sept 08

she will be in the uk in july and must go back to work in 16 sept 2008 because of work and stilll waiting for the company to sell can she apply for a visa now or does she have to wait 28 days before the visa expires
i am hoping that under these circumstance can she get a extention for the same day service ...
the reason why i want this is because if we do this by post it might take longer and we would need to take back the passport.....
does this mean that the application for extention is withdrawn
please can anyone advise me or what to do
kind regards

As she arrived late, you are right in saying she must apply for a FLR(M) extension. It may help if you include a good covering letter explaining her situation. She has to satisfy the requirements of paragraph 284, in particular (vi). See also Section 1 - Spouses (4.3 and 4.5) and Flr How Strict Are They?, not enough letters addressed to my wife.
