Naturalization and working more than 20 hours

Post by SSon » Sun Feb 10, 2019 4:35 am

Dear All,

I will apply for naturalization soon and have a question regarding working more than 20 hours when I was a student years ago.

So, when I was a student I was working in company A part-time but that company didn't have fixed hours per week, just an on-call service. So, while working with company A I started to work with company B part-time but stopped to work for company A. However, I officially quit company A after a few months so when I requested my work history from HMRC it shows that there are a few months when I was working in both companies. I however didn't break 20 hours per week rule with this one but from HMRC history shows 2 jobs the same period.

Next, while working with company B I have found another job at company C and was working in both places (less than 20 hours per week in each company). However, combined it was more than 20 hours. I was working like this for around 4-5 months and then left company B and was working for company C only, again, less than 20 hours. This is also visible in HMRC work history (Start dates and end dates). The hours do not shown in work history though, only Start and End dates and from that dates it is visible that I worked in 2 places on the same time.

So, if I honestly write all Start and End dates of all my jobs as per HMRC in naturalization form, what are the chances that caseworker will actually dig them to find out how many hours I worked in each workplace? Because it is absolutely normal to work in 2 places as long as combined hours are less than 20 hours. So can they find this out or they won't dig?

Also, if they find out that I was working more than 20 hours, will this affect current ILR? Can it be cancelled based on that or it will only affect naturalization?

I can still wait for a few more years when all this will be more than 10 years old and will not be required to be declared but want to get BC as soon as possible.

I want to mention that I never had any other immigration issues and this was never revealed in all my visa applications.

Will appreciate your comments on this. Thanks.

I read someone’s post on this forum who was in the same situation. He got refused and got a 10 years ban. I cant find that topic as it was a hike ago but I recall HO established his actual hours based on data from HMRC.

I only declared last 7 years of employment record from PSW through to Tier-2 visa. My application was approved but outcome could be different for your application I only intend to share my experience.

Thanks and sorry for a late reply.

Have you been working in 2 places more than 20 hours as myself? Thanks.
