Hi all friends, Am 27 yr old, from BOTSWANA, came to ENG. with good intensions for higher education, but unfortunately, had to drop out due to fin.strain bak home. defferd 1 semtr frm uni, rejoined bak, but, towards end of final semester, wen applied 4 extension, student visa got refused. tried ma best for appeal, but failed. being eldest, was not in position 2 go back, due to adverse fin. situation bak home. overstayed for two years, and supported family & siblings. Now, engaged with gal frm ma country, who is nurse in Dublin. Kindly request for valuable suggestions & advice. from all good hearted ppl in this forum. Thanks & God bless many more. [/b]

Unless you can travel to Ireland to get married, you would have to return home to Botswana and get married there. As your spouse is a non-EU/EEA national and you are an overstayer, you would have to apply for the relevant visa from the Irish embassy in Botswana - any application made in the UK is likely to be refused because you don't have legal status here.

tHANKS A lot my friend for your reply. Ok, As u said, our marriage is in Aug, @ Botswana and should I mention in spouse visa application abt ma overstay in UK, or, am afraid if they would find out and refuse my spouse visa coz of my immigration history.If so they refuse me, will i ever be able to re apply or is it a permenant ban? does anybody know in detail what I should do? Am a bit worried, please help me. Thank u.

If you are asked about any overstays in Ireland or elsewhere, you will need to be honest and tell them - failure to do so might be seen as deception on your part, which would make any likelihood of obtaining a dependent visa even harder.

However, if you are not asked about this, then there's no need to inform them of it.

I don't know anything about Irish immigration rules, sorry, but, the Irish embassy in SA is also for Botswana, although maybe they have a consular office in Gaborone.
