HSMP holder- American partner

Hi all,


I've recently obtained my HSMP entry clearance and will be moving back to the UK this coming August 2008, which I'm excited about

My partner is American, and I wish for him to join me in London. What would be the best way for us to do this.

Will the fiancee visa be our best option and what documents does this require? alternatively,we are getting married next June 2009 in my home town. is the spouse visa a better visa to do this through?

Unfortunately, the Fiancé(e) visa is not an option.

Details of who can qualify as a dependant can be found on the page Can I include my family on my application?

For someone to be eligible to be included in your application as your dependant they must be:

* your husband, wife or civil partner; or
* your unmarried or same-sex partner; or
* your child aged under 18.

To be considered as your unmarried or same-sex partners, you and your partner must have been living together in a relationship equivalent to marriage for the last two years. You must be intending to continue to live together in the United Kingdom. You will also need to show us that any previous marriage or similar relationship by either partner has permanently broken down.

Entry clearance requirements for spouses/civil partners, dependent children and unmarried partners of highly skilled migrants ( Rules Paragraphs 194 and 197 )

Prior entry clearance is mandatory

Applications from spouses and children under 18 as dependants of highly skilled migrants should be handled on the same basis as those of work permit dependants (see Paragraph 17.14 of this chapter).

You should try to initially enter the UK within 28 days (4 weeks) of your entry clearance's effective date.

So really my only option would be to make a valid spouse visa.

And is this easily obtainable once we do get married (in my home town- Jordan- so a marriage certificate will be from there) ?

No, HSMP Dependent visa. You don't need to be married but you do need two years provable living together if not married.
