overstayer non eu getting married to a british

Myself and my african fiance/partner are planning to get married this year sometime in her country of origin. The reason why we are not married is because of divorce i have been going through, of which my solicitor has assured us it should be through very soon.

My question is; just in case this divorce hasn't gone through by the time the 'grace period' thats the 1st October, is over what can we do? I mean if we went back to her country after the grace period and got married then. What will happen? i have read somewhere that we should wait for one year before we can apply for her re-entry;is that true? Am a contractor, the thought of one year is just unbearable

What i was thinking behind my head if this is the case. Could we then re settle in another EU country ie i go france or ireland? Is this possible? any ideas what the process is?
