Question about extension for ILR 5 Year Route

Post by goldenhour90 » Sun Jun 09, 2019 10:23 am

Hello!

I was granted my spouse visa in November 2018 on a 5 Year Route.

I am aware that I am meant to be out of the country for less than 90 days in the 12 months leading up to the extension of my spouse visa (which will be in May 2021).

I was hoping if someone can please help me understand if I am allowed to be out of the UK for around 100 days in the first year. I am spending time with my family who are in India for as long as possible until I start work in September. After I commence work, I have standard work holidays which won't exceed 26 days or so.

i can't find any particular guidance. Basically, I would have taken 100 days in the first year of my spouse visa, and around 30 days out of the UK in my second year.

Is this ok?? Thank you once again

There is no absence limit for the holder of a Spouse visa. You're confusing the 90 absence rule with an application for British citizenship.
