Settled status under EU rule

Post by Osmo » Sat Aug 03, 2019 4:49 pm

Hello All

Could someone with good knowledge kindly provide some information, please?

Question: I've been granted ILR - Settled status for being a spouse of EEA national through marriage. However, the marriage dissolved now and I'm wondering if I need to reapply for ILR under Right to Remain - EU route or I can continue on my current ILR and it will valid until I apply for naturalization.

> Came to the UK in Feb 2010
> Married to EEA citizen Nov 2012
> Residence permit 5 yrs granted April 2013
> Residence permit renewal rejected May 2018 (Due to discontinue of the treaty right by EEA spouse)
> Residence permit 5 yrs granted July 2018
> ILR granted Feb 2019 (Under EU settled scheme before Brexit)
> Marriage dissolved July 2019

Hope the above points are clear and understandable, please reply with the right information.

Many thanks in advance.

Regards

No, once you have your ILR status, you are settled and your residence in the UK is not dependant on any application for further leave. However, it can be revoked on criminality grounds but this would not count a dissolution of marriage, unless obtained through deception.

I add my vote to this: ILR is ILR and not dependent of any previous immigration condition. It's a permanent right to reside. An ILR doesn't go away because a divorce, unemployment or things of this nature.
