ILR 10 Year Route

Post by Azzy4243 » Tue Aug 06, 2019 1:14 am

Hi everyone,

First of all thanks in advance to everyone whoever will be responding to my enquiry.

Basically currently i am a student in UK and about to complete my 10 years. I have two questions to clear up:

Firstly when does the 10 year limit starts?
Either from the time the visa was allocated or from the date i arrived in UK. As, in the UKBA eligibility criteria both are mentioned so i am bit confused about it.

Secondly my wife is living with me in UK as PBS Dependant TIER4, so when ill apply for my indefinite leave to remain on what basis i should apply for her? and do i need to apply for her at the same time as mine or i should wait for my ILR to come and then apply for her?

Also how long will she be needing to get to her ILR as she's already been in UK from last 2 years.

I will really appreciate any help in this matter.

Secondly my wife is living with me in UK as PBS Dependant TIER4, so when ill apply for my indefinite leave to remain on what basis i should apply for her? and do i need to apply for her at the same time as mine or i should wait for my ILR to come and then apply for her?
As you are applying for ILR under long residence, once this is granted your wife will have to switch to FLR(M). This will re-set her immigration clock to zero, putting her on a new 5 year (2.5 x 2.5) year path to settlement (ILR). She will need A1 level English from a Home Office approved test/test provider and will have to meet the minimum income level of £18,600 p.a (this can be joint income).
In addition to the £1,033 visa fee there will also be the £1,000 NHS Surcharge to pay.

Also how long will she be needing to get to her ILR as she's already been in UK from last 2 years.
5 years from the date her FLR(M) visa is issued, see above.

I will really appreciate any help in this matter.

Hi Casa thank you so much for your prompt response, as i will be getting my indefinite leave to remain and its impossible to show 18600 income straight away. Is there any other way around it? because my wife and I both arent working so this seems impossible to do right away. whats the best possible way for her to apply for her visa?
