Can Spouse travel to the UK from Netherlands alongside EU National

Post by ranasamir » Wed Aug 28, 2019 4:54 pm

Hi everyone,

I am passport holder of Netherlands and I live and work in the United Kingdom for the past few months.
My wife has a Valid Pakistani passport with Netherlands spouse BRP card.(clearly stating my name on the BRP back but no wording of EU or EEA on the BRP, the look of the BRP is excatly similiar to the UK BRP)

My first question is, can she travel with me by air or by train from Netherlands to the United Kingdom alongside me (Netherlands passport holder)?

I have applied for my pre settled status in the UK and awaiting decision.

But she want to come to the UK for 5 day holidays from tomorrow.

Because we want to travel tomorrow for Holidays only, so I cannot apply her EU settlement scheme family permit at this point of time.

Please advise if she is eligible to travel and also article 10 has any implications please highlight and please post any guidance link that can help me.

I have contacted the the airlines and they are not sure about it.

If anyone has gone through this experience in the past please share.

Finally its a great forum, so well done to everyone who contributes in it.

Regards

Hello

And respond to questions one-by-one and it will tell you.

Still, many people working at check-in desks don't know. Sometimes even the people working at the border may make your trip difficult. Go early to the airport...

Take a marriage certificate with you too.

If she has been issued a Residence Card under domestic Dutch law (i.e. she is in the Netherlands as the spouse of a Dutch citizen), then her Residence Card is not an Article 10/Family member of a Union Citizen Residence Card and she does need a visa to travel to the UK.

There is a reasonably good chance that airlines will not allow her to board the aircraft without the correct documentation.

Thanks for your prompt reply.

My tried this early morning but airline didn't allow us at the boarding gate for the same reason not an Article 10 card, they kept phoning UK head office and immigration but nobody answered the call. However, my cousin 3 days ago used the same airline easyjet and travelled from Amsterdam to Manchester in the afternoon, No issues, only UK immigration asked to prove she is the spouse they showed residence BRP from Nethrlands which had husband name on the back. Also few people have travelled from Spain and Italy in exact similar situations successfully. seems it works mostly on the discretion.

My pre settled status is under process, should i wait or i can instantly apply for EU settlement scheme Family permit for my wife?

or would EEA Famliy permit be more appropriate for my wife

for my DAD in Pakistan, will it be EU settlement scheme permit or EEA family permit to come and join me in the UK?

Thanks again and i am sorry if i am repeating myself or this has already been discussed in another thread in this forum, i just created this post as i was in bit of rush.

Regards
