EEA Family Permit while EU National is outside Europe

Hi everyone,

It's the first time I m using this forum so forgive me if this threat already exist on forum, so here is the scenario and friend of mine married a Polish Citizen and she is currently in the USA they got married in the USA while he was on fiance's visa.

Now he wants to come the UK on a Family Permit but she is in the USA and he is in Pakistan at the moment is it possible for him to apply for Family Permit while she is in the US and then when he gets a visa they both travel to the UK it is also a possibility for her to go to Pakistan and then they both travel to the UK togather or they both travel to the UK on the same day? this is what I found in the link below but not sure if this means they both have to be in the EU. Thanks in advance for any help

Yes they are both planing to live in the UK

I believe they can apply with both options (while she’s in US or in Pakistan). Rules are saying EU citizen need to be in UK OR be traveling to UK in next 6 months (as you were citing). Rules are also saying that EU citizen need to prove that he/she is QP only after 3 months in UK. So technically this lady doesn’t need to have job for now at least.

I’m opened to corrections here, but having a job and a place to live in UK makes the application stronger. So maybe it’s a good idea for her to first try to settle in UK if they don’t feel pressured by time?

Thanks for replying, the problem they have is that she has job in the US and to risk that without knowing if he is going to get his visa is a bit worrying, that's why they want to try and get the family permit while she is in the US and he is in Pakistan if they are not successful then they can decide the next move.
