Work permit refused need help

Post by ims780 » Sun Aug 03, 2008 10:21 pm

Hi,

As recently my company has applied for work permit and i got a following refusal letter as mention belows

My Background:- As myself is concerned i have done masters in IT(2003)and Masters in management(2006 from UK, working as a software engineer ince 2006 till date with current basic salary: £20,000 K

Reason for rejection (31 July):

Thank you for your application to employ ******who is
currently in the United Kingdom.

I am sorry to inform you that from the information provided, we are unable to approve the application for ******.

Why we have made our decision?

The following shows where you have not demonstrated that the work permits criteria have been satisfied.

The Job

We only issue work permits for jobs that require people with either:

*a UK degree or equivalent or;
*a relevant HND level qualification or;
*a HND level qualification that is not relevant and one years' relevant work experience or;
*at least 3 years relevant work experience that is at NVQ level 3 or above;

Please note that we consider the skill requirements of the job, not the qualifications or experience of the individual to be employed.

The NVQ 3 competence involves the application of knowledge and skills in a broad range of varied work activities performed in a variety of
contexts, most of which are complex and non-routine. There should be considerable responsibility and autonomy, and control and guidance of others is normally required.

We have assessed the qualifications and skills required as stated by you for the post. On this occasion, you have not confirmed or substantiated that the job is at a level of skill and responsibility that qualifies.
Our assessment is based on all the documentation that you have submitted with the application to demonstrate the level of the job, specifically:

*the application form
*job descriptions
*the salary on offer to the employee, which is less than we would normally expect for a job that would qualify for a work permit.

As my employer thinking of applying for review so please anybody help me with my case ?
