Tier 2 ICT to Tier 2 General

Hi,

I am in Tier 2 ICT. My spouse is in Tier 2 General. I understand there is a cooling period of 1 year for me to switch from Tier 2 ICT to Tier 2 General unless my salary is above 159 K GBP. I've below questions.

1) If I switch to Tier 2 dependent now and after 3 months if I get any offer above 159 K GBP, can I switch to Tier 2 General?
2) if someone offers 135 K basic + 20% bonus, it is equivalent to 160 K, is this allowed to switich from Tier 2 ICT to Tier 2 General directly?
