Indefinite leave to remain

Post by RVPS » Wed Feb 19, 2020 4:08 pm

Hello all,
I am British citizen and I am wondering if someone could help me decide if my husband is entitled to ILR.
My husband had LOTR in Dec 2015 until 06/2018- 2.5years. In 2016 we got married and we applied for an extension on his visa and he got D-LTRP, 2.5yrs spouse.
Can he apply for ILR or will it be another extension?
Thank you in advance.

My understanding is that one will require 2 X 2.5 yrs spouse visa to qualify for ILR. I dont think he can combine his 2.5yrs spouse visa with 2.5 yrs LOTR. If I am wrong, I guess other more experienced memebrs of the forum can correct me
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Time spent with grant under D-LTRP cannot be combined with time spent under LOTR for ILR
