EU Settlement Scheme Family Permit - application for parent

Hi,

I need some advice. I am a Filipino national and married to an EU citizen. We have both applied to the EU Settlement Scheme and we both have Settled Status.

I would like to bring my father from the Philippines to stay with us in the UK and was wondering if this was possible under the EU settlement scheme family permit?

My questions are:
1. Are we required to show dependency? What sort of documents can I show to prove dependency?
2. Can my father make the application and will they attribute it to my settled status or my husband's settled status (because he's EU)?
3. Do I need to be earning a certain amount in order to apply him under this permit?

As your father qualifies as close family member, you will hear that "the dependency is assumed".

In my experience, the only thing that is assumed with such applications is a refusal. So prepare to show serious proofs of dependency and ideally over an extended period of time. That dependency is not on you, but on your EEA husband. He needs for instance to show that he pays the bills for your father, medical invoices, travels, sends money... That should go well beyond a few Western Union remittances.

You are not an EEA national. You can't use EEA routes to sponsor your dependent. Your EEA husband is the sponsor, not you.

3. Do I need to be earning a certain amount in order to apply him under this permit?

Contrary to UK immigration routes where specific revenue/savings thresholds are defined, you should just show that you can cover his basic needs.

In practice, you are better off showing that you have a good revenue making it clearly credible that you can support him.

Make also sure you have enough disposable income in the UK, because in the unlikely event of this application working, you will end up with a massive financial burden on your shoulders. I know people who managed to bring adults under this route (sometimes it works) and now they are begging to send them back home. Often social conflicts and financial pressure are under-estimated by sponsoring families.
