Switching from ICT Dependent to T2 General COVID

Post by PB_GB » Wed May 20, 2020 12:48 am

Hello,

I am looking to switch from T2 ICT dependent visa to Tier 2 General visa and I am currently in the UK.

In this regard, my employer has already assigned me a restricted certificate of sponsorship in March.

As per the T2 policy guidance, switching into Tier 2 General requires to leave the UK and make Tier 2 General application from the home country (India). Therefore, I've made Tier 2 General visa application (also paid IHS) in Mar-20 and had booked my flights to visit home country at that time to complete further actions like providing biometrics etc.

However, due to COVID-19 outbreak globally in March, couldn't travel as planned.

My queries are as below.

1. As I have already submitted an application (outside of the UK) in home country in March, for how long will that application stay valid? (Biometrics submission is pending as can't travel)
2. Can I travel whenever the government allows travel into the country and submit my biometrics to complete the process?
3. Please note that the planned travel date mentioned in application (back to UK) was in April and that has already passed. Will this matter when is application is processed?
4. My COS will get expired in June first week. If my current application stays valid, will this have any impact if I couldn't provide biometrics before that?

5. I understand that the COS can only be used once. In my case I have used it for existing application in home country but haven't been able to submit the biometrics (as I couldn't travel). In this scenario if I withdraw the application without completing my biometrics, is it possible to use it against another application if the travel is allowed and COS is still valid?
In other words, if I haven't submitted my biometrics, the application is not taken by the HO for processing. Therefore, is the COS really considered "used" in this case?

Thanks in advance.

Hello,

Do you have an update? Were you able to proceed with Visa application within UK?

Your Cos expiry doesn’t matter if you’ve already submitted the application. The expiry is an issue if you hadn’t submitted it.
So don’t worry.

Hi ,

Can I please ask you if you are still required to travel to India to switch?

My situation is slightly different as I will be doing all these now when I get my COS next week

Cheers
Seetha
