New Tier 2 RCOS granted, cannot leave UK to switch from Tier 5 visa expiring next week

Post by ssui » Tue May 26, 2020 3:29 pm

Hello,
I am working for a company in the UK as a Tier 5 Intern and my visa is due to expire next week(3rd June).
With the extension in the UK guidelines for Visas till 31July I have been asked to extend my Tier 5 Visa.

The company was in the process of applying a Tier 2 General visa for me and the RestrictedCOS is already granted in my name. However I have been asked to extend the current visa to 31st of July by contacting the COVID homeoffice team as the company is unsure if they can still apply for the Tier 2 Visa from inside the UK.

Travelling back to Thailand is not possible as the tickets I had booked were cancelled due to flight cancellations and the embassies in Thailand are closed.

Any help or pointers for me to determine the following?

- Shall I submit the Tier 2 Application immediately so that I can remain in the country once the Tier 5 expires next week?
OR
- Shall I extend the current Tier 5 visa till it expires on the 31st of July , go back to Thailand and my company applies for a new RCOS?

Any help will be greatly appreciated.

If you're given a CoS in your name and a starting date you can go ahead with Tier 2 application within the UK and start working, now that you have this opportunity.

Switch to long term visa:
You can apply from the UK to switch to a long-term UK visa until 31 July 2020 if your leave expires between 24 January 2020 and 31 July 2020. This includes applications where you would usually need to apply for a visa from your home country.

You’ll need to meet the requirements of the route you are applying for and pay the UK application fee.

This includes those whose leave has already been extended to 31 July 2020.

You can apply online. The terms of your leave will remain the same until your application is decided.
T2 application
You may allow employees to start work before their visa application has been decided if:

you have assigned them a CoS
the employee submitted their application before their current visa expired
the role they are employed in is the same as the one on their CoS
