Exercising Treaty Rights choices .. please help !!!

Post by jundoc » Wed Aug 27, 2008 2:25 pm

Hi everybody ..

I found this forum of prime help so far. Many thanx for you all in advance.

Well I am a non-EU national who holds 5-year residence in Spain because my wife is Spanish. We got married one year ago and lived in Spain before relocating to England. I did apply for FP in Madrid and got it last July. Thereafter we moved over here after I received a job offer from a hospital in Liverpool. (cose I am a doctor).

Currently we are going to apply for EEA1 (my wife) and EEA2 (me). The problem is that my wife is not exercising any "Treaty Rights" at the moment!! , except as a jobseeker !! (if that is gonna to work). Since she doesn't speak English well her chances to find a job are quite not that much. (although she doesn't need to work as I will be able to afford living costs here).

So my question would be how can she exercise her Treaty rights apart from being worker or self-employed. She thinks of enrolling in some course here, but would the HO be convinced with any type of courses? or are there any specific requirements for accredited educational establishments or the course duration ..etc?

She has enrolled in ESOL course which lasts for 9 months in one learning center which is supported by the city council here. Does this work for an EEA1 application?

If she is going to apply as a jobseeker, what are the supportive documents she may need to include? and what are the chances of getting our applications cleared out ASAP?

It's really weird all this stuff. But I need to be legally resident in the country to commence my job soon. (I was offered the 1-year vacancy based on my FP visa)

Lastly I would mention that we don't have so enormous savings at the moment, and we'll be living on our future salary.

Your help is highly appreciated.

Why not apply for UK work based visa as you will easily get it. That way you have access to UK nationality in 5 years in your own right. More expensive but does not depend on the treaty rights of your wife.
