Few Queries

Post by uklondonuser » Mon Sep 01, 2008 10:58 pm

Hi All,

My wife is on HSMP.

I recently got Tier 1 visa valid till 2011, but I will get PR in Feb 2009.
I am in the UK since 2004 on Work Permit.

1) I would like to convert my wife's HSMP visa to dependant Tier 1 general, so that she can also apply for PR in feb 2009.
Please let me know if this is possible.

2) I will also like to add my child, born in UK.. Will I need to pay 395 + 395 GBP?

3) Signature for my child, will my signature be enough or a thumb impression for child is reqd?

Thanks a lot

1. Your wife cannot switch to dependent status through an in-country application. Who all are eligible to switch (read make an in-country application) to dependent status is clearly mentioned on the UKBA website and in the Tier 1 (dependent) policy guidance.
2. If you wife converts to dependent visa then she will be able to apply for ILR only after 2yrs. of staying in UK as a "dependent", and not in Feb 2009.

Have you applied for the child's LTR in the past? If so, then is he in UK as a dependent of a WP holder (i.e. - you) or of an HSMP holder (i.e. - your wife)?? If the latter, then you cannot make an in-country application on his behalf.
But if a LTR application has never been applied for (for the child), then you make add him as your dependent (Tier 1 dependent) now.
