**Urgent Help** ILR Application Submission dates Clarification

Hello Moderators / Gurus,

Yesterday I have submitted my Online application for ILR set (0) 5 year Tier 2 general Route. After submission I came to know that there some confusions around Online Application date & Biometric appointment dates for consideration of Eligibility period.

Visa Issued date: 02-11-2015
UK entry date: 05-11-2015
Online application submission date: 24/09/2020
Biometric appointment date: 09/10/2020

I have assumed that, on the date of Bio metrics - 09/10/2020 - I will Be in 28 days eligibility criteria.

Can some one help out now with suggestion, How i need to proceed Now ??
Option 1:
Cancel application and Re apply a fresh application after the actual eligibility date
Option 2:
Mention the assumption with reference to guide lines ( Decision date / 28 days after appointment date) in the Cover letter

Date of application is the date you pay and submit online. You only qualify from 5th Oct. So technically you applied earlier. But, if a decision is made on the date when you qualify i.e. after 5th Oct, CW should consider date of decision to calculate your continuous residency.

Since you booked an appointment for 9/10 a decision can not be made before 5th Oct anyways. Its best to write a cover letter and mention the reference from the guidance and attach with your documents before biometrics.

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application
