Change visa category

Post by MeharK » Tue Nov 17, 2020 4:14 pm

I am on dependant visa and because of the disputes with my husband, I am thinking to leave him and I have the ILR coming in Oct 2021 but he has already refused to help me in visa and in finances as well as I am not working here. Can I change my visa category from dependant to student so that I can be independent to work and live separately here but have confusion to start study on dependant visa as i am thinking to join in the January batch and I have the visa till Oct 2021 so can I change it at that time or it is better to start with a new visa only. And more I have a huge gap as I came here after marriage and busy in family, will it be easy to get admission even after 10 yrs of gap.

You can switch to a Student visa. See https://www.gov.uk/student-visa/switch-to-this-visa

However a Student visa is not for someone to "work and live separately here", but so they can study, with some limited work allowed alongside. If your main purpose is work or living in the UK, your credibility as a student may be questioned by both the university and the UKVI caseworker.

If you are leaving your husband, you cannot be in the UK as his dependant anyway. He is obliged to report the change of circumstances to the Home Office.

That's not a visa issue. You need to speak directly to the university where you plan to study, and get their advice on your suitability for the course.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
