ILR on HSMP

ILR on HSMP

Hi forum members,

just wanted your opinion on my case. I have been on HSMP for 5 years now and about to apply for ILR begining of October. My current leave to remain is untill 09/2010. My employer has given me contract till september 2010 as my visa exiry date is september 2010.

When I asked my employer for employment letter for ILR they have obviously mentioned that in the letter that I am contracted till sep 2010. how strict Home office Is for perminent employment? In my actuall contract it is actually mentioned that reson for fixed term employment is WORK Permit.
(I am not on work permit though I am on HSMP) and I am taking my contract to my PEO appointment.

please advise do you see any problem with that they will refuse to see me and ask me to post the application.

your end of contract date might give you some problems...as it states 09/2010...just spot on your apply for ILR...

HO wants to determine if you are still needed by your company after this date so this might be a problem... BTW how come a permanent position has an end date? seems odd

others may chip on this I suppose.

would it still be a problem? This is not a perminent position due to my visa expiry date which is sep 2010.

I know that this permenent employment is essential for work permit holder but nit really sure about HSMP.

any idea?

just forgot to mention that last year I have got 3 years extention till 2010. I have been working with this employer since january 2007 and my first contract was till expiry of my last leave to remain which was sep 2007(just for 9 months contract) when I got my leave to remail my contarct has been extended till visa expiry date which is sep 2010.

This is a permenant position but my employer dosen't give contract beyond the leave to remain date. Hopefully once I have ILR then I will get permanent contract.

Sorry my mistake Alina76...I knew I glanced on the date erroneously but no chance to re-edit it. If you're applying this October 08 and you have a letter till Sep2010 then it will mean you are needed by the company. 2 years is a lot of time.

As you are on HSMP, you will not need a firm offer of employment to extend your visa anyway. All you need to be able to prove is that you have been economically active enough to meet the relevant points criteria. The fact that you have employment for another 2 years is simply the icing on the cake!

IF possible start a company and do business if yr employer objects than leave job and start company

than you will be 100 % fine

PEO Appointment for ILR Denied

I am in the same situation. Would be completing 5 years in nov 2008. Initially I was on Work Permit and now I changed to Teir1(General) valid till 2011.

Today when I called PEO for an appointment for ILR, I was told that for Tier1 General Visa, the ILR needs to be applied only by Post and not in Person. If I apply by post then it will take 4 to 14 weeks for processing.

Has anyone here had the same issue. Please let me know.

Thats a lot of work. I wouldn't do that until you got your ILR not before it.

Never heard of that. You have to apply by post for Tier 1. Think that you are leaving something out.
Second what is wrong with applying by post?

Well if you apply by post, then the standard time is 4 to 14 WEEKS!
