Dear Experts, Specialists and/orFriends with similar experiences,
1. I came to the uk on 13th may 1998 on a student visa.
2. My wife and two children joined me on 15th October 1998 as dependents of a student.
3. Since then we have had continuous extensions granted on student/dependent visas till 2005 when I switched to Work Permit and have had mine and family members' Limited Leave to Remain continuously extended since then based on different work permits.
4. Our current Limited Leave to Remain (WP) expires on 30th September 2008.
5. I and my wife passed Life in the UK Test in Aug 2008. All our stay is lawful and our absences from the UK are with in the percribed limit.
6. I applied for ILR at the PEO on 19th Aug and got my passport back on 12th Sep with stamp of Settlement Visa (Indefinite Leave to Remain) dated 5th Sep 2008.
7. My wife and two children will complete their 10 years' qualifying period on 15th October but their current Leave to Remain expires on 30th September i.e. 15 days before they comeplete their 10 years.
The advice is sought on
1. Can my wife and two children apply for ILR on 17th Sep (i.e. 28 days before they comeplete their 10 years lawful stay in the UK)? The observation here is that their current leave expries on 30th Sep and does not take them to the threshold of qualifying period on 15th Oct. If yes, which form to use??
2. Or do they have to apply for FLR(M) for 15 days' period based on the fact that I have the ILR and they have not yet comepleted 10 years. And after 15 days of FLR(M), they have to apply for ILR based on long stay rule.??
3. Also please advise which forms are to be used for Wife's ILR and for children (udner 18)'s ILR???
I would really appreciate some guidance on this as I am really cutting very close to the expery of their current visas on 30th Sep.
